Townhome owners allege Delaney's Roofing & Restoration poorly installed roof

Editor's note. Eddie Delaney of Delaney's Roofing sent the following comment in response to the article: "It has always been our intentions to work with Ms. Speer. In reference to the warranty, Over a year ago, Delaney's roofing replaced Ms. Speer's portion of the roof in  town home community  twice, which at that point we had a third party roofing consultant then inspect the roof, finding proper installation and with out any faulty workmanship. Upon the information provided by the roofing consultant we had a chimney company inspect the chimney caps, finding water leaks as well as faulty installation of the preexisting chimney.  Ms. Speer on several occasions would not allow workers into the residence, using racial slurs and going as far to accuse me personally, as well as my workers of stalking her at night, even referencing that I am a sexual predator. At that point my attorney advised Delaney's to extinguish all contact with Ms. Speer. This claim has been an unfortunate consequence of Ms. Speer's actions. We feel that we have gone above and beyond our responsibilities regarding the alleged allegations by Ms. Speer. We have an open and ongoing insurance investigation in place and are taking the proper channels in coming to some type of resolution to these allegations brought on by Ms. Speers."

HOUSTON – The owners of a townhome allege a contractor hired by the townhome association to replace the roof poorly installed it.

Michele Speer and Angela Speer filed a complaint on March 26 in the Harris County District Court against Edward Paul Delaney, doing business as Delaney's Roofing & Restoration, and Forrest Lake Townhome Association Inc. alleging breach of warranty and negligence.

According to the complaint, Forrest Lake Townhome Association hired Delaney to repair and replace the roof at its townhomes, one of which the plaintiffs own. They allege beginning in 2016, they noticed numerous leaks in their property, causing significant water penetration to their unit and substantial damage to their property, including mold growth and a collapsing ceiling.

The plaintiffs hold Delaney and Forrest Lake Townhome Associations Inc. responsible because defendant Delaney allegedly failed to properly secure and affix the roof in their unit and failed and refused to honor the warranty.

The plaintiffs seek actual and consequential damages, pre- and post-judgment interest, attorney's fees, court costs and all other relief to which they are entitled. They are represented by Keval Patel of Law Office of Keval Patel PC in Sugar Land.
