Consolidated Services of North America alleged to have not paid for all hours worked

HOUSTON – Two Harris County individuals allege that their former HVAC company employer did not pay them for all hours worked.

Ronson Caligone and Richard Esardial, individually and on behalf of all others similarly situated, filed a complaint on March 29 in the Houston Division of the Southern District of Texas against Consolidated Services of North America LLC alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiffs were employed by the defendants from August 2017 to January or February of this year. They allege they were not paid for the drive time in between jobs and that the defendant would deduct hours and only pay the plaintiffs the number of hours it approved for an individual repair.

The plaintiffs hold Consolidated Services of North America LLC responsible because the defendant allegedly refused to compensate them for their work in excess of 40 hours, required them to work off-the-clock and/or manipulated their time records and failed to maintain accurate time and pay records.

The plaintiffs request a trial by jury and seek an order allowing this action to proceed as a collective action, award for all unpaid regular and overtime compensation, liquidated damages, attorneys’ fees and costs and such other and further relief.
