HOUSTON – Nan Ya Plastics Corp. U.S.A. has been implicated in a former employee’s sexual harassment lawsuit, per recent Houston federal court records.
Jennifer Fillmore filed the suit on Apr. 3, alleging the defendant’s human resources head harassed her when she was employed as a personal assistant in the department.
Fillmore accuses the unidentified HR manager of committing acts, including but not limited to grabbing her private parts, making inappropriate comments, and watching pornography in her presence.
The misconduct reportedly occurred daily, to which court papers assert Nan Ya knew about but failed to address.
Fillmore adds the manager harassed other female employees.
The suit further explains that it is company policy for workers to report sexual harassment to their supervisor, but Fillmore’s was the manager himself.
“Fillmore feared retaliation if she reported to anyone outside the Wharton plant; however, she finally got up the courage to do so,” the original petition says. “Although something was done to make the harassment stop, Fillmore started to face hostility and retaliation from fellow employees.”
The complaint states that the defendant suspended and then fired Fillmore. The plaintiff says her termination was in retaliation to her harassment complaints.
Consequently, she seeks unspecified monetary damages and a jury trial.
Robert “Bobby” Lee, Megan Dixon, and Meagan Whitley of the law firm Lee & Braziel, LLP in Dallas are representing Fillmore.
