Motorcycle rider alleges International Paper Co. driver turned into path, caused collision

MARSHALL – An Arkansas man alleges a logging truck driven by an Atlanta, Texas man turned into his path and caused a collision.

Clay Davis filed a complaint on April 3 in the Marshall Division of the Eastern District of Texas against International Paper Co. and Mancel Sprayberry alleging negligence.

According to the complaint, the plaintiff alleges that on Nov. 30, 2017, he was traveling on FM 3129 in Cass County when Sprayberry, while in the course and scope of his employment with defendant International Paper, turned into his path and caused the plaintiff to collide with the trailer.

The plaintiff holds International Paper Co. and Sprayberry responsible because defendant Sprayberry allegedly failed to yield to the right-of-way, failed to keep a proper lookout, failed to timely apply brakes and carelessly made a lane change when it was unsafe to do so.

The plaintiff and seeks actual damages, plus interest, costs of court and such other and further relief to which he may is entitled. He is represented by Roger W. Anderson of Freeman Mills PC in Dallas.
