Woman alleges National ATV Rental Corp. ATV malfunctioned, caused her to strike tree

HOUSTON – A Harris County woman she suffered a brain injury because an all-terrain vehicle she was riding malfunctioned.

Ana Ortiz filed a complaint on April 3 in the St. Louis Circuit Court against National ATV Rental Corp. alleging negligence.

According to the complaint, the plaintiff alleges that on June 12, 2016, she was seriously injured when the ATV she was riding in malfunctioned, causing her to fly off and strike her head against a tree. She alleges she sustained a traumatic brain injury. The suit states the ATV was owned by the defendant.

The plaintiff holds National ATV Rental Corp. responsible because the defendant allegedly negligently rented an ATV with dangerous defects, failed to ensure that it was safe and failed to provide warning that it was in a state of disrepair.

The plaintiff seeks monetary relief of more than $1 million and such other lawful and equitable relief. She is represented by R. James Amaro and Ashlee E. Dunham of The Amaro Law Firm in Houston.
