Macy's shopper alleges apple slice caused fall

HOUSTON – A Harris County woman alleges she fell in a Houston department store because of food on the floor.

Rosaura Cruz filed a complaint on April 3 in the Harris County District Court against Macy's Retails Holdings Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on March 17, she received personal injuries when she slipped and fell on an apple slice on the floor while shopping at defendant's Macy's department store at 5135 West Alabama in Houston. 

She alleges suffered serious injuries that resulted in medical expenses, pain and suffering, disfigurement and lost wages as a result of the fall. 

The plaintiff holds Macy's Retails Holdings Inc. responsible because the defendant allegedly failed to inspect its premises to discover the dangerous condition and to make it safe and failed to provide warning the danger existed.

The plaintiff requests a trial by jury and seeks monetary relief of less than $75,000 and such other relief to which she is entitled. She is represented by Jesus A. Salinas and John A. Daspit of Daspit Law Firm in Houston.
