HOUSTON – A tenant of an apartment complex alleges she was injured by a section of plywood that was not secured near her unit.
Leola McNulty filed a complaint on April 17 in the Harris County District Court against Globix Palms Rolling LLC, doing business as The Palms on Rolling Creek, alleging premises liability and negligence.
According to the complaint, the plaintiff alleges that on April 17, 2016, she was injured when a large piece of plywood covering a dangerous opening fell onto her leg. The suit states the covering had been placed over an opening in the railing near her unit and had not been secured. She alleges she suffered serious injuries and damages that resulted in pain and suffering, medical expenses, lost wages and physical impairment as a result.
The plaintiff holds Globix Palms Rolling LLC responsible because despite prior notice of the dangerous condition, the defendant allegedly failed to make it safe nor to provide adequate warning.
The plaintiff requests a trial by jury and seeks monetary relief of $100,000 or less and all other relief to which she is entitled. She is represented by Henry D. Drewinko in Houston.
