BEAUMONT – A Jefferson County man alleges two insurance companies failed to accept coverage of a claim in a reasonable amount of time.
Chadrick Goans filed a complaint on March 16 in the Jefferson County District Court against Globe Life and Accident Insurance Co. and American Income Life Insurance Co., doing business as Ai Records, alleging violation of Texas Insurance Code and other counts.
According to the complaint, the plaintiff's mother died in March 2015 as a result of an auto-pedestrian accident. The suit states the plaintiff was the named beneficiary of a life insurance policy in his mother's name.
The plaintiff alleges that despite the fact that his mother had been killed in an auto-pedestrian accident unrelated to any medical condition, the defendants "repeatedly sent form letters advising (they) needed to obtain and investigate plaintiff's mother's records, despite the uncontested accident nature of her death unrelated to any medical condition," the suit states.
He claims such scheme or plan was done in an attempt to delay payment of the policy benefits. The suit states the plaintiff was issued payment in March 2016.
The plaintiff holds Globe Life and Accident Insurance Co. and American Income Life Insurance Co. responsible because the defendants allegedly breached the terms of the contract and insurance code by failing to request all required information within 15 days and made payments without including interest and penalties.
The plaintiff seeks judgment against the defendants, special and general damages, pre- and post-judgment interest and such other relief to which he is justly entitled. He is represented by E. Hart Green of Weller, Green, Toups & Terrell LLP in Beaumont.
