Buyers allege Houston home built by 5177 Builders has defects sellers did not disclose

HOUSTON – The buyers of a Houston home allege that defects were not disclosed by the sellers.

Leslie Garb and Mary Garb filed a complaint on April 24 in the Houston Division of the Southern District of Texas against 5177 Builders LTD, Ian McNiece and Peggy McNiece alleging negligence, breach of contract and other counts.

According to the complaint, the plaintiffs allege that on Sept. 9, 2016, they purchased a Houston house from the McNieces that was built by 5177 Builders. The suit states in 2014, the McNieces submitted several work orders to 5177 Builders for repair of defects found in the home. The plaintiffs allege when they purchased the home, the construction defects were not disclosed to them.

The plaintiffs hold 5177 Builders LTD, Ian McNiece and Peggy McNiece responsible because 5177 Builders allegedly was negligent in the home's construction and the McNieces failed to disclose the defects.

The plaintiffs seek reasonable and necessary attorney's fees for the preparation of this suit, prosecution of this suit, trial and all appeals. They are represented by T. Ernest Freeman and Stephen G. Scholl of The Freeman Law Firm PC in Houston.
