Homeowners association blames Harvey flooding on decade-old bulkhead

HOUSTON – A suburban Houston homeowners association alleges a nearly decade-old project attributed to Payne Brothers, Inc. was responsible for flood damage during a hurricane last year.

Seagate Homeowners Association sued Payne Brothers in the Harris County 190th District Court on May 4 in response to a bulkhead the defendant constructed directly over a drainage pipe near NASA Road 1 in El Lago.

The lawsuit alleges the bulkhead was built in 2010 without the HOA’s knowledge, adding the project included a backfill that reportedly created an obstruction for the flow of water.

Hurricane Harvey made landfall along the Upper Texas Gulf Coast in late August 2017 and inundated the region with approximately 50 inches of water. El Lago was one of the cities affected by the storm, whose effects the suit claims were worsened by the bulkhead.

Seagate HOA, which is joined by El Lago residents Kevin Ebrom and John Tully in the litigation, consequently seeks unspecified monetary damages and a jury trial.
