Tyler man's court documents allege age discrimination, wrongful termination against Delek Refining

MARSHALL – Tyler resident William Clover has brought an age discrimination lawsuit against his former employer, Delek Refining, Ltd.

Clover’s suit, which was filed on May 4 in the Marshall Division of the Eastern District of Texas, asserts his termination from the company was part of “an unexplained exodus of older workers.”

The defendant employed Clover for nearly 40 years until Mar. 10, 2017.

Court documents recall the plaintiff being inquired numerous times about when he was going to retire, as well as being disciplined for supposedly not following proper start-up policies despite having done the job for years.

Clover adds the respondent gave him 20 minutes to sign a resignation or risk losing back vacation pay from 2016. The complainant refused to sign on grounds the document “untruthfully” accused him of several wrongful acts.

Delek purportedly replaced Clover with a younger worker.

Consequently, the plaintiff seeks $250,000 in damages.

He is represented by Bob Whitehurst of Tyler.
