HOUSTON – A tenant of a Houston apartment complex alleges he warned the owner/operator of the condition of the balcony before a floorboard gave way and caused him to fall.
Andres Bustamante filed a complaint on May 4 in the Harris County District Court against GPI Real Estate Management Corp., doing business as Summerstone Apartments, alleging negligence.
According to the complaint, the plaintiff alleges that in June 22, 2016, he was standing on his apartment balcony at the defendant's complex when the floorboard he was standing on gave way, causing him to fall and be injured. He alleges prior to the fall, he notified the defendant that the balcony had protruding nails from another floorboard when he moved in June 16, 2016.
The plaintiff holds GPI Real Estate Management Corp. responsible because the defendant allegedly failed to properly inspect and repair the balcony before renting it and failed to provide adequate warning that such danger existed.
The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but less than $1 million and all other relief to which he is entitled. He is represented by Crystal N. Beverly of Beverly Law Group PLLC in Houston.
