GALVESTON – A Louisiana welding inspector alleges his project management and inspection employer failed to pay him the correct rate for overtime work.
Wade Hawk, individually and on behalf of all others similarly situated, filed a complaint on May 9 in the Galveston Division of the Southern District of Texas against Cyrus J. Guidry & Associates LLC alleging that the project management company violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that beginning in 2014 to the present, he regularly worked more than 40 hours per workweek for the defendant without receiving overtime premiums for all hours worked in excess of 40 per week. He alleges he was paid straight time for the additional hours.
The plaintiff holds Cyrus J. Guidry & Associates LLC responsible because the defendant allegedly refused to compensate their inspectors at a rate of no less than one-and-one-half times their regular rate at which they were employed and failed to maintain accurate time and pay records.
The plaintiff requests a trial by jury and seeks an order allowing this action to proceed as a collective action, award for all unpaid overtime compensation, liquidated damages, attorney's fees, costs and interest and all other relief to which he may show himself to be justly entitled.
