SHERMAN – A Fort Worth company is alleged to have failed to pay inside sales employees overtime pay.
Cory Wilson filed a complaint individually and on behalf of all others similarly situated on May 11 in the Sherman District of the Eastern District of Texas against Ba-Ker Tank Head Co. Inc. alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he routinely worked in excess of 40 hours per workweek for the defendant without receiving proper overtime compensation. Instead, the suit states the plaintiff was paid a base salary plus a job bonus for all hours worked.
The plaintiff holds Ba-Ker Tank Head Co. Inc. responsible because the defendant allegedly failed to compensate employees at a rate of one-and-one-half times their regular rate for all hours worked in excess of 40 in a single workweek.
The plaintiff requests a trial by jury and seeks to recover unpaid overtime compensation, liquidated damages, attorneys’ fees, and costs and all other relief as may be necessary and appropriate. He is represented by Drew N. Herrmann of Herrmann Law PLLC in Fort Worth.
