Tenant files suit against Texas Westchase III Properties, MRIO over alleged fall injuries

HOUSTON – A Fort Bend woman alleges an elevator's failure to stop at level with the floor caused her to trip and fall.

Anne Heinrich filed a complaint on May 14 in the Harris County District Court against Texas Westchase III Properties Limited and MRIO Inc., doing business as Moody Rambin Interests, alleging premises liability and negligence.

According to the complaint, the plaintiff was tenant of a Houston building owned by Westchase and managed by MRIO. She alleges on May 24, 2016, she was in the building's elevator and was injured when she tripped and fell due to an unmarked, uneven floor because the elevator did not stop level with the floor. She alleges the injuries from the fall required medical attention and treatment.

The plaintiff holds Houston Texas Westchase III Properties Limited and MRIO Inc. responsible because the defendants allegedly failed to properly maintain and survey the premises and failed to eliminate a dangerous condition.

The plaintiff requests a trial by jury and seeks monetary relief of no less than $1 million and all other relief that is lawful and equitable. She is represented by Brian S. Humphrey II of Abraham, Watkins, Nichols, Sorrels, Agosto & Friend in Houston.
