HOUSTON – A Friendswood consumer alleges a corporation headquartered in California contacted him with telemarketing calls without his permission.
Joe Shields filed a complaint on May 16 in the Houston Division of the Southern District of Texas against Gawk Inc., Scott Kettle and Kennedy Weaver alleging that they violated the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that the defendants have invaded his privacy with their unsolicited and unauthorized robocalls to his cellphone. He alleges the defendants contacted him in July 2017 to advertise Gawk's stock and again in February 2018 to advertise a service to purchase homes from owners in financial distress.
The plaintiff holds Gawk Inc., Kettle and Weaver responsible because the defendants allegedly contacted the plaintiff without his prior express consent.
The plaintiff seeks all damages and permanent injunctive relief as allowed by law, costs of court and all other remedies to which he may show himself justly entitled. He is representing himself.
