HOUSTON – A Highlands resident alleges he routinely worked 84 hours a week for his former employer and was not paid for the overtime work.
Gerald Hernandez individually and on behalf of all others similarly situated filed a complaint on May 16 in the Houston Division of the Southern District of Texas against Helix Energy Solutions Group Inc. alleging that the oil and gas services company violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that during his employment with defendant for more than nine years, which ended in January, he regularly worked 84 hours per week. He alleges he was not paid proper overtime compensation but instead was paid on a day-rate basis.
The plaintiff holds Helix Energy Solutions Group Inc. responsible because the defendant allegedly failed to maintain accurate time and pay records and failed to pay overtime wages at a rate of no less than one-and-one-half times his regular rate for all hours worked in excess of 40 per week.
The plaintiff requests a trial by jury and seeks an order allowing this action to proceed as a collective action, award for all unpaid overtime compensation, liquidated damages, attorneys’ fees and costs, post-judgment interest and all such other and further relief to which he may show himself to be justly entitled.
