Ag Power employee seeks more than $1 million over injuries caused by tree

HOUSTON – A man hired to clear land after Hurricane Harvey is seeking $1 million after a tree struck him in the face.

Lance Halstead filed a complaint on May 18 in the Harris County District Court against Phillips & Jordan Inc., et al. alleging negligence.

According to the complaint, the plaintiff alleges that on Nov. 25, 2017, he was a chainsaw operator employed by Ag Power working on a jobsite clearing land after Hurricane Harvey. While cutting a tree marked by the defendants, the suit states the tree came out of the ground and struck him in the face. 

The plaintiff holds Phillips & Jordan Inc., et al. responsible because the defendants allegedly failed to properly inspect the jobsite, failed to provide equipment in a reasonably safe condition and failed to ensure the trees marked for cutting were safe for cutting.

The plaintiff requests a trial by jury and seeks monetary relief of more than $1 million. He is represented by M. Paul Skrabanek, Michael E. Pierce of Pierce Skrabanek PLLC in Houston.
