Data analyst alleges Capital One Services paid men in similar positions more than women

BEAUMONT – A female employee of a credit card service company alleges she was paid less than similarly situated male co-workers.

Brittany Abrams filed a complaint on May 22 in the Eastern Division of the U.S. District Court for the Eastern District of Texas against Capital One Services LLC alleging that the former employer violated the Fair Labor Standards Act and the Equal Pay Act.

According to the complaint, the plaintiff was hired by the defendant in 2012 and in 2016, was transferred to the human resources department as a data analyst. She alleges two male employees that were hired after her and who performed the same work were paid more than she was. The suit states one of the men has been with the defendant for less than a year but makes $39,000 a year more than the plaintiff.

The suit states the plaintiff was compelled to resign on April 2.

The plaintiff holds Capital One Services LLC responsible because the defendant allegedly intentionally engaged in unlawful employment practices.

The plaintiff requests a trial by jury and seeks back pay for the difference in her pay rate and that of the similarly situated males performing the same work, all damages, attorney's fees, costs of this suit, prejudgment and post-judgment interest and all other equitable relief as may be appropriate.
