Plastic wrap alleged to have caused shopper's fall at El Ahorro Supermarket

Medical malpractice 06

HOUSTON – A shopper at a Houston supermarket alleges plastic wrap caused her to fall at the store.

Bacilia Moreno filed a complaint on May 22 in the Harris County District Court against Rosara Investments LLC alleging premises liability.

According to the complaint, the plaintiff alleges that on March 19, she was shopping at defendant's El Ahorro Supermarket in Houston when she tripped and fell over clear plastic wrap surrounding an empty pallet. She alleges she sustained serious personal injuries that resulted in medical expenses, pain and suffering, mental anguish and lost earnings.

The plaintiff holds Rosara Investments LLC responsible because allegedly despite having knowledge of the known danger, the defendant allegedly failed to make it safe and failed to provide adequate warning and notice of such danger.

The plaintiff requests a trial by jury and seeks monetary relief of $100,000 to $500,000 and such other and further relief to which she may be entitled. She is represented by Kevin J. Connolly and Ryan A. DeHoyos of DeHoyos & Connolly PLLC in Houston.
