Former R&L Carriers driver alleges age, race were factors in his termination

HOUSTON – A local truck driver alleges his age and race were factors in his termination by his former employer.

Milton Wiltz filed a complaint on May 22 in the Harris County District Court against R&L Carriers Inc. alleging violation of Title VII of the Civil Rights Act and the Age Discrimination in Employment Act.

According to the complaint, the plaintiff is African-American and began working for the defendant as a truck driver in 1998. He alleges as he neared retirement age, the defendant began "pressuring and harassing him" about retirement.

The suit states in January, the plaintiff was in an auto accident while working and was injured. The suit states he was terminated the following month after failing a blood test after the accident because he had taken a prescribed medication for pain.

The plaintiff holds R&L Carriers Inc. responsible because the defendant allegedly terminated his employment because of his age, race and/or disability.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages of $1 million, attorney's fees, costs and such other and further relief as the court deems just and proper. He is represented by Victoria Plante-Northington of Plante Law Firm PC in Houston.
