Motorcyclist's death in crash results in lawsuit against Bacliff business

Car accident 24

GALVESTON – A Bacliff establishment has been implicated in a lawsuit arising out of a fatal motorcycle accident, recent Galveston County District Court records indicate.

Shawn Michael Rogers’s sons brought the suit against Bayou Duck, Inc., doing business as Bayview Duck Restaurant & Pub, its proprietors, and one of its servers on May 24 in the Galveston County 56th District Court.

Jacob Wayne Rogers and Justin Rogers accuse the defendants of serving their father “copious amounts of alcohol” on Oct. 13, 2017.

Court papers state that the decedent left the business on his motorcycle, lost control on League City Parkway, and crashed. He was reportedly killed because of the accident.

The plaintiffs fault the respondents for not attempting “to cut-off serving alcohol to the decedent or intervene in any manner.”

Consequently, they seek unspecified monetary damages and a jury trial.

Spencer G. Markle of the law firm Markle • Delacruz, LLP in Houston serves as the sons’ lead counsel.
