La Marque accused of disciplining police officer for participating in investigation into lieutenant's remarks

HOUSTON – A La Marque police officer is suing his employer for racial discrimination and retaliation, per recent Houston federal court records.

Harvey Walton filed a lawsuit against the City of La Marque on May 30, alleging the defendant disciplined him for participating in an investigation of a lieutenant who made racist remarks.

Walton is reportedly one of two African American officers in the La Marque Police Department.

He explains that after the conclusion of the aforementioned investigation, he met with his supervisors and was placed on a 90-day Performance Improvement Plan for supposedly failing to clear assigned investigations in a timely manner.

Court papers assert the police department has an “accepted custom” that investigations “are not completed timely because of the limited number of officers on staff,” adding accommodations were made.

The plaintiff says he was not afforded such accommodations, and the respondent deprived him of any opportunity work extra jobs.

He further accuses the city of publishing the “unwarranted” employee disciplinary plan in an unsecured location on the department’s employee computer drive.

Consequently, the complainant seeks unspecified monetary damages and a jury trial.

He is representing himself.
