Telecommunications technician says former employer owes him $34K in back overtime pay

HOUSTON – A field service engineer/technician asserts that his employer terminated him for bringing up the matter of uncompensated overtime.

Jose Semenario filed a lawsuit against The Switch LLC on Sept. 5 in the Harris County 234th District Court, claiming the telecommunications company owes him unpaid overtime wages.

Previously tasked by the defendant to perform manual labor in the field installing television broadcasting equipment at professional sporting events, Semenario asserts that he was a salaried employee who was required to work more than 40 hours per week.

“He was not paid overtime for those hours worked,” the suit says.

According to court papers, the plaintiff amassed “544.75 hours in excess of 40 hours per week” at an overtime pay rate of $63.14 “per overtime hour worked” at the time of his firing.

Consequently, Semenario seeks at least $34,395.52.

He is represented by Stephen E. Menn of the Law Office of Stephen E. Menn in Houston.
