SHERMAN – A New York photographer has filed a federal copyright lawsuit against a suburban Dallas shooting range.

In court documents filed on Dec. 11 in the Sherman Division of the Eastern District of Texas, Matthew McDermott accuses Crossfire Defense Academy & Range, LLC of running his photograph of Alex “Shaya” Lichtenstein, a man who plead guilty to bribing the New York City Police Department.

According to the suit, the defendant ran an article featuring the image in question.

“The defendant did not license the photograph from the plaintiff for its article,” court filings say. “The defendant did not have the plaintiff’s permission or consent to publish the photograph on its Web site.”

McDermott adds that there was no communication between him and the respondent.

Consequently, he seeks unspecified monetary damages and a jury trial.

Richard Liebowitz of the Liebowitz Law Firm, PLLC in Valley Stream, N.Y. is representing the complainant.
