GALVESTON – A Galveston corporation allegedly failed to pay liquidated damages as outlined in a contract after it canceled an event at a Galveston hotel.
Wyndham Hotel Management filed a complaint on Feb. 1 in the Galveston County District Court against Moody Insurance Group alleging breach of contract and unjust enrichment.
According to the complaint, the plaintiff alleges that in August 2018, it entered into a catering contract and hotel event agreement with the defendant related to an event to be held in October 2018 at the Hotel Galvez & Spa.
The suit states the defendant canceled the event on Sept. 28, 2018, and failed to pay the liquidated damages per the terms of the contract. As a result of defendant's actions, the plaintiff alleges it has been damaged in the amount of $57,610.65.
The plaintiff holds Moody Insurance Group responsible because the defendant allegedly failed and refused to pay the amounts owed to plaintiff pursuant to the catering contract and hotel event agreement.
The plaintiff seeks judgment against defendant for liquidated damages in the amount of $57,610.65, together with interest, attorneys’ fees and costs of suit. It is represented by David V. Wilson II of Mehaffy Weber PC in Houston.
