Worker alleges he is owed 10 years of overtime

HOUSTON —A man is suing former employers, alleging he was not paid overtime for 10 years.

Nicholas Allison filed a complaint Feb. 19 in Harris County District Court against Racks Are Us LLC, doing business as Fisher Equipment, Rack It Up LLC, doling business as Texas Racking, William Ronald Fisher and Lloyd George Ross III, alleging violation of the Fair Labor Standards Act.

According to the complaint, Allison was employed by the defendants from May 2008 to April 2018. The suit states Allison regularly worked more than 40 hours a week but was never paid for his overtime hours at a rate of time and half as required by the FLSA.

Allison seeks trial by jury, all unpaid overtime, attorney fees, pre- and post-judgment interest and court costs. He is represented by attorneys Josef F. Buenker and Vijay Pattisapu of The Buenker Law Firm in Houston.
