Apartment complex visitor alleges he was falsely accused of assaulting security guard

HOUSTON — A Harris County man is suing a Houston apartment complex, alleging he was falsely accused of assaulting a security guard.

Marcus A. Bishop filed a complaint June 13 in Harris County District Court against Western Eagle Security Inc., FSC Morningside/Alanza Brook Associates LLC, FSC Steel Lake/Alanza Brook Associates LCC (Alanza Brook Apartments) and Munam Lazim, alleging gross negligence and malicious prosecution.

According to the complaint, Bishop was hired by a car dealership Dec. 4, 2018, to repossess a vehicle at the defendant's Alanza Brook Apartments, 3030 Dunvale Road, Houston. 

Bishop said when he arrived at the apartment complex Dec. 5, 2018, he began to hear gunshots. The suit alleges police were called to the scene and the defendants' security guards said Bishop had attempted to attack them, which was not true. Bishop says he was arrested and charged with felony aggravated assault and spent three to four days in jail without the possibility of bail. The plaintiff says he eventually was acquitted of all charges although his personal life was disrupted by the false allegations and he sustained lost wages and emotional distress.

Bishop seeks trial by jury, exemplary damages, interest, court costs and all other just relief. He is represented by attorney Michael J. Bins of Potts Law Firm LLP in Houston
