Family alleges doctor's failure to remove plastic components during surgery led to woman's death

HOUSTON — A Brazoria County man is suing a lawyer after a doctor allegedly failed to remove plastic components from his wife during surgery, which, ultimately, led to suffering and death.

Terry Gregory Peden, individually and as administrator for the estate of Tammy E. Henderson Peden, deceased, filed a complaint June 21 in Harris County District Court against Reginald E. McKamie Sr., alleging breach of contract and negligence.

According to the complaint Tammy Henderson Peden underwent a gastric band surgery in 2007 conducted by Dr. Felix Spiegel, and over the next seven to eight years suffered with abdominal pain. The suit alleges she underwent three additional surgical procedures to remove the gastric band and the plaintiffs discovered that Spiegel had left a plastic catheter and tubing inside Peden. 

McKamie was hired to represent the plaintiffs' interests but the suit says he did not provide proper representation. Tammy Henderson Peden, who is an attorney, filed a suit against McKamie but she died April 18, 2017, and her surviving relatives are seeking damages.

Terry Gregory Peden seeks actual and exemplary damages, attorney fees and expenses, interest and all other just relief. He is represented by attorney Sarnie A. Randle Jr. of S.A. Randle & Associates PC in Houston.
