Former employee alleges Villarreal Drywall failed to pay proper overtime wage

HOUSTON — A former employee suing a drywall business, alleging he was never paid the appropriate overtime wage.

Edin Omar Mejia, individually and on behalf of all similarly situated persons, filed a class action complaint July 1 in the Houston Division of the Southern District of Texas against Villarreal Drywall Inc. and Edward Villarreal, alleging violation of the Fair Labor Standards Act.

According to the complaint, Mejia worked for Villarreal Drywall as a construction worker from December 2015 to November 2018. The suit states the plaintiff regularly worked in excess of 40 hours a week but was never paid the overtime premium he was owed as required by the FLSA.

Mejia seeks trial by jury, judgment equal to unpaid wages, liquidated damages, attorney fees, interest and all other just and equitable relief. He is represented by attorneys Josef. F. Buenker and Vijay Pattisapu of The Buenker Law Firm in Houston.
