A theatre company is suing a rental company, alleging that they were never given scenery that they paid to rent

HOUSTON —A theatre company is suing a rental company, alleging that they were never given scenery that they paid to rent.

Theatre Under the Stars filed a complaint on Aug. 22 in the Harris County District Court against Vance Entertainment LLC alleging breach of contract and common law fraud.

The plaintiff contacted the defendant on April 19, 2019 to request a quote for the rental  of some scenery. The plaintiff was provided with a quote and the plaintiff gave the defendant the full rental price: $17,400. The defendant, though contractually obligated to the plaintiff, never delivered the scenery. The defendant contacted the plaintiff on March 12, 2019 and explained that there was an issue with the shipping and the plaintiff agreed to allow the delivery to be delayed. The plaintiff was prepared to receive the shipment on March 16, 2019 and paid a team to help unload the scenery, paying them $1,455.92. The defendant, however, failed to provide the scenery to the plaintiff and have therefore breached contract.

The plaintiff is seeking up to $100,000, attorneys' fees, court costs, interest and just relief. The plaintiff is represented by Quentin L. Smith and Brooke A. Noble of Vinson & Elkins LLP in Houston.
