HOUSTON — A Harris County man is suing a Houston storage business, alleging his property was demolished and he has not been compensated for his loss.
Abdel Salem filed a complaint Aug. 23 in Harris County District Court against Orange Door Development LLC, doing business a Public Storage, alleging negligence, negligent misrepresentation, breach of contract and breach of warranty.
According to the complaint, Salem rented space from the Public Storage facility at the corner of Fondren and Bissonnet in Houston in 2017. The plaintiff said he had many personal items stored at the facility, totaling $27,520.99 and including furnishings, tools and memorabilia.
The suit states the defendant's property was damaged Aug. 25, 2017, by Hurricane Harvey and the plaintiff's storage unit was directly impacted. Salem alleges he was out of the country between Aug. 31, 2017, and November 2017 and after he returned he learned that his stored goods had been lost through the defendant's decision to demolish the Public Storage unit.
Salem alleges he was never notified of Public Storage's plan to destroy the property, even though the defendant had the plaintiff's contact information. The plaintiff said he has submitted a claim to the defendant's insurance provider but the provider has denied Salem's property loss in full and have offered to pay only $3,000.
The suit alleges Public Storage also has failed to pay the plaintiff for the loss of his property. The defendant, the suit states, was obligated to protect Salem's goods and make the effort of care for them. Through failing to protect the plaintiff's goods, the lawsuit states, the defendant breached its contractual obligation to Salem and is indebted for the damages suffered.
Salem seeks trial by jury, damages, attorney fees, court costs, interest and all just relief. He is represented by attorney J.A. Asafi of Asafi Law Firm in Houston.
