Car owner alleges dealership repossessed vehicle and she was not given chance to buy it back

HOUSTON — A car owner is suing a dealership alleging her vehicle was repossessed and she was not given the opportunity to buy it back.

Santana Henderson filed a complaint Aug. 30 in Harris County District Court against Safeway Trading Inc., doing business as Mario Used Cars, alleging violation of Uniform Commercial Code, conversion, deceptive trade practices and illegal debt collection practice

According to the complaint, Henderson purchased a vehicle from Mario Used Cars on Oct. 27, 2018. The defendant alleges Henderson fell behind on payments and Mario Used Cars the defendant repossessed the vehicle on Feb. 6, 2019. 

During the conflict, the plaintiff moved from Discover Creek Bloulevard, to Old Holzwarth Road in Spring. Despite the defendant allegedly learning of Henderson's new address, on Feb. 22, 2019, the plaintiff had to request that correspondence be sent to her new house. 

The suit states the defendant deliberately sent a proposal for acceptance of collateral in full satisfaction of debt letter to the plaintiff's old address, so the plaintiff did not receive it in a timely manner. Mario Used Cars then allegedly repossessed the vehicle, and the plaintiff requested that the defendant provide an accounting of the amount that she needed to get the vehicle back but the defendant failed to do so, in violation of law.

Henderson seeks between $100,000 and $200,000, attorney fees, court costs, interest, trial by jury and all just relief. She is represented by attorney Alexander B. Trueblood of Trueblood Law Firm in Austin.
