Shook, Hardy & Bacon L.L.P. issued the following announcement on Oct. 30.

Shook Of Counsel Tanya Chaney presented, “Patent Litigation: Overcoming Evidentiary Landmines at Trial,” at the 2019 annual meeting of the American Intellectual Property Law Association in National Harbor, Maryland, Oct. 24, 2019.

Chaney was part of a panel on patent trial best practices that featured discussions from several patent attorneys from across the country.

Chaney recounted a scenario where an inventor and a competitor were in a dispute over a similar device that was slightly different from the original patent. The original device ran perpendicular; the competitor’s device ran parallel. Lawyers for the competitor found the product claims from the inventor could not be verified and the product did not work as illustrated in photos. Eventually it was determined the photos from the original inventor were staged.

“It should come as no surprise that these photos were inadmissible,” Chaney told the panel.

Chaney is a trial lawyer with extensive federal court experience in every Texas district and across the nation; with a focus on patent, trademark, copyright and trade secret matters, she has first-chair experience in all aspects of intellectual property litigation.
