HOUSTON — A former CVS shift supervisor at a Texas CVS who was diagnosed with breast cancer claims she was mocked and humiliated by a supervisor for wearing a head wrap after losing her hair during chemotherapy, denied proper medical leave and fired in retaliation for her leave.
Maria Del Carmen Lopez filed a complaint Nov. 5 in the Houston Division of the Southern District of Texas against CVS Pharmacy, Inc and CVS Caremark Corporation alleging violation of the Family Medical Leave Act (FMLA).
Lopez, who worked for CVS for 15 years, claims that two supervisors continually made fun of workers and mocked them, according to the suit. On October of 2016, when she was diagnosed with breast cancer, Lopez alleges she suffered ridicule, was told to take off her head wrap because she was "lying" about loosing her hair and told she needed to use vacation time instead of medical leave. Lopez was fired on November 7, 2017 for what she claims is a "fabricated reason" after returning back to work from a surgery.
Lopez seeks monetary relief, trial by jury and all other just relief. She is represented by Ashok Bail of the Bail Law Firm PLLC in Houston
