PLANO — A Texas man is suing multiple entities claiming he received calls using an Automatic Telephone Dialing System (ATDS) in violation of federal and state law in an effort to sell him car warranty services.
Craig Cunningham filed a pro se complaint Nov. 11 in the Sherman Division of the Eastern District of Texas against Vehicle Protection Specialists, LLC also known as Vehicle Service Center, Daniel Laurent, Sunpath, Ltd corp doing business as Sunpath LTD Corp of Delaware, Adam Marino, Wesco Insurance Company, National Car Care Center, Inc and Omnisure Group LLC alleging violation of the Telephone Consumer Protection Act (TCPA) and Texas state law.
Cunningham claims that he "received multiple calls from a variety of spoofed caller IDs that contained a pre-recorded message and were initiated using an automated telephone dialing system," according to his complaint. "The calls were on behalf of each of the defendants in this case offering their products/services as a result of the calls."
Cunningham seeks monetary relief of $3,000 per call in addition to $4,000 in statutory damages and $25,000 in punitive damages as well as other just relief.
