Law

Cozen O'Connor recently issued the following announcement.

Location: Webinar

Date & Time:

Start Date: 02/24/2021

Start Time: 02:00

End Time: 02:30 pm ET

Details:

During the presidential campaign, then candidate Joe Biden said that he didn’t think “we spend nearly enough time focusing on antitrust measures.” Now that Biden is president, all indications are that we should expect more aggressive enforcement by both the Department of Justice and the Federal Trade Commission. At the same time, state attorneys general of both parties are continuing to flex their own antitrust muscles. To top it off, a bipartisan consensus is emerging in Congress that the antitrust laws need strengthening. During our next Corporate COffee Break, we will discuss this changing landscape and discuss how it may affect businesses, including a dive into:

  • Which types of mergers and acquisitions – and which industries – are likely to receive increased antitrust scrutiny
  • The Competition and Antitrust Law Enforcement Reform Act of 2021, the bill introduced by Senate Democrats
  • Contractual terms that may raise antitrust risks such as non-compete, exclusivity, and Most Favored Nation (MFN) provisions
  • How broad non-solicitation agreements among employers have gone from commonplace to criminally illegal in a decade
  • How state antitrust laws, and the AGs that enforce them, differ from federal laws and enforcers
