Attorney’s appeal of disbarment judgment dismissed because of her death

HOUSTON – A suggestion of death filed in appeal over a disbarment judgment has led the First Court of Appeals to dismiss the appeal.

Afton Jane Izen filed an appeal of the judgment of disbarment signed by the trial court on May 3. The Commission for Lawyer Discipline brings such actions.

On Aug. 16, Izen’s counsel filed a suggestion of death.

The State Bar of Texas lists Izen as deceased.

On Oct. 26, the First Court dismissed the appeal, court records show.

“Because of appellant’s death, this appeal is moot,” the opinion states. “Accordingly, we dismiss the appeal for lack of jurisdiction. We dismiss all other pending motions as moot.”

Izen graduated from the South Texas College of Law in 1981.
