Houston restaurant alleges former financial officer stole $50,000

HOUSTON — A Houston restaurant claims its former financial officer fraudulently withdrew funds from the company's checking account to deposit in his personal accounts. 

MSHB Restaurants LLC filed a complaint Nov. 30 in Harris County District Court against Shesh Sharma alleging breach of fiduciary duty, fraud, theft and other claims. 

According to the plaintiff's complaint, MSHB was formed in 2016 by Sharma. They allege that prior to his resigning from the company as financial officer in January of 2021, that Sharma withdrew $50,000 from MSHB's corporate checking account and deposited the funds into his personal accounts. 

MSHB claims Sharma withdrew the money without authorization and that the withdrawal was in violation of his agreement with the company. They further claim that in November of 2021, they demanded Sharma return the funds which he has failed to do in violation of his fiduciary duty. The plaintiffs also claim Sharma fraudulently indicated to the bank that he was authorized to withdrawal funds from MSHB and that his actions left the company in financial distress. 

MSHB seeks monetary relief, interest, trial by jury and all other just relief. He is represented by Gary Maze of Maze IP Law PC in Broomfield.
