HOUSTON — The estate of a millwright worker claims the worker died from mesothelioma due to exposure to asbestos.
Harriett Maly, individually, as heir and wrongful death beneficiary of John F. Maly and as executrix of the estate of John F. Maly filed a complaint Dec. 1 in Harris County District Court against Triplex Inc., Et Al., alleging liability, breach of warranty and negligence.
According to the plaintiff's complaint, Maly was employed as a union millwright for Transamerica Corporation from 1996 through 2004 and built parts for use on IMO pumps. The plaintiffs allege Maly was exposed to asbestos from insulation and gaskets and through his delivery of those parts to various industrial facilities. The plaintiffs further allege that Maly's exposure to asbestos caused him to develop mesothelioma which led to his death.
Among the plaintiff's claims is that the defendants knew or should have known that their asbestos-containing products and machinery would be dangerous and harmful to Maly's health and that they failed to warn of the exposure of toxic asbestos. The plaintiffs allege the defendants also should have tested their products and developed a way to keep those products from contracting asbestosis.
The plaintiff seeks monetary relief, interest, trial by jury and all other just relief. They are represented by M. Clay Fostel of The Fostel Law Firm PLLC in Georgetown and Houston.
