Man claims Lexus fuel system failure caused serious collision

HOUSTON — A man claims his Lexus' fuel system failure caused a violent collision. 

Zain Moosa filed a complaint Dec. 9 in Harris County Court against Toyota Motor North America Inc., Westlex Corporation doing business as Westside Lexus and BMW of West Houston alleging strict liability and other claims. 

Moosa, according to his complaint, was driving his 2014 Lexus GX 460 on Katy Freeway on Sept. 22, 2020. He alleges that due the vehicle's low pressure fuel pumps defect that causes "systemic fuel system failures," he suddenly lost control of the car and had a "violent collision." 

Moosa claims the Lexus was defective and unreasonably dangerous and that Toyota failed to use safer alternative designs. He also claims that years prior to his collision, Toyota knew of the defect, failed to repair or replace the defective systems and continued to sell and required its customers to drive the vehicles with a defective fuel delivery system. 

He alleges the defendants  failed to recall the subject vehicle to warn customers of the defect and did not disclose any "post-sale" information regarding the defect. Moosa claims he suffered physical pain, disfigurement, impairment, lost wages and incurred medical expenses as a result of his accident. 

Moosa seeks monetary relief, interest, trial by jury and all other just relief.
