Customer alleges auto salvage company fraudulently sold incorrect part

HOUSTON — A Texas auto salvage company is facing a suit alleging it fraudulently sold the wrong part to a customer and refuses to issue a refund. 

Krushnaprasad Rathod filed a complaint  Dec. 16 in Harris County District Court against Sam's Auto Salvage Inc., and Jebril Husam alleging violation of the Texas Deceptive Trade Practices Consumer Protection Act, fraud and other claims. 

Rathod alleges in his suit that on May 7, 2021, he ordered a specific part of the console for a 2008 Lexus that he was customizing from the defendants. He claims he sent the defendants more than $300 for the part and that the part he received did not match the one depicted in the text message he was sent by the defendants or that was described on the merchant sales receipt. 

Rathod further claims that he discussed in detail about the part which was "rare and difficult" to locate with the defendants prior to ordering and that they assured him they had the exact part he needed. He alleges that the defendants refused to refund, exchange or allow a return of the incorrect part. Rathod claims the defendants made false representations which caused him financial loss in purchasing and shipping. 

Rathod seeks monetary relief, interest and all other just relief. He is represented by Remington Alessi of Alessi Legal PLLC in Houston.
