The Office of Federal Contract Compliance Programs (OFCCP) has announced that federal contractors and subcontractors must begin registering with the agency through a new Contractor Portal and then annually certify whether they have developed and maintained an AAP for each establishment and/or functional unit, as applicable.
This new process – which OFCCP is implementing without having first provided employers with the opportunity to raise concerns or provide meaningful feedback – has left contractors with many questions including:
- What will I have to do to comply?
- How will this new requirement change my exposure to OFCCP audits?
- Is this requirement legal and do I really have to register?
- What do I do if I’m not sure if I’m a federal contractor?
