California employers face ever-increasing challenges in today’s workplaces in managing their employees’ claims of disability and requesting reasonable accommodations. Disability discrimination claims against employers continue to be heavily litigated in the courts and are among the most frequent claims brought to the California Department of Fair Employment and Housing (DFEH) and the federal Equal Employment Opportunity Commission (EEOC). Given this landscape, it is desirable that employers periodically review these complex laws, their policies and procedures, and best practices to effectively and proactively manage the myriad issues they may face with respect to engaging in the interactive process with their employees to determine what, if any, reasonable accommodations may be required. As added twists, COVID-related and now MPX (formerly known as monkeypox) related spread causes the continued impacts and challenges of remote and hybrid work schedules, and requests for leave as a reasonable accommodation, all combine to create new challenges for employers and new opportunities for disgruntled employees to file claims against their employers when they feel they have not been reasonably accommodated for their actual and/or perceived disabilities.
