HOUSTON – A notice of settlement has been filed in a lawsuit alleging a man was injured while playing softball at Houston Sportsplex.
Plaintiff Kevin Bobo filed suit against Houston Sportsplex on Dec. 12, 2020 in Harris County District Court.
Court records show the case was set for trial back in March but was continued and reset for Jan. 30, 2023.
A notice of settlement was filed on April 19.
According to the lawsuit, on Dec. 13, 2018, Bobo was playing softball at Sportsplex when another player (John Doe) collided into him, causing him to sustain “significant injuries.”
The agreed motion for continuance states that Bobo was playing catcher and the right-fielder threw the ball home to get a guy out from the other team that was coming into home base. As Bobo attempted to catch the ball, the runner ran him over as he attempted to score.
Bobo contends he was knocked unconscious, transported by ambulance to Memorial Hermann Southwest and underwent emergency surgery.
The suit accuses the defendants of negligently “failing to enforce safety rules and regulations to keep invitees safe.”
Bobo sought damages for his past and future mental anguish, pain and medical expenses.
