Wrongful death suit brought against apartment complex over shooting

HOUSTON - A wrongful death lawsuit has been brought against an apartment complex over a shooting on its premises. 

Margarito Tale and Elvira Villagomez, individually and as representatives of Kevin Nava’s estate and Austin Palomino, filed suit against Houston North Apartment Homes and Allied Orion Group. 

According to the complaint, on Nov. 19, 2022, Nava was shot and killed, and Palomino was shot and seriously injured at the defendants’ residential complex. The incident occurred because, among other things, defendant failed to ensure the complex was properly staffed, failed to resolve and/or properly mitigate dangers, affirmatively rented to dangerous tenants, and allowed and/or created a haven for criminal activity.

As a result of the Incident, Nava was killed, and Palomino has suffered tremendous physical, mental, and emotional harm.

The plaintiffs are alleging negligence and gross negligence and are seeking actual, consequential and exemplary damages.
