The Dykema team of Michael Carey, Daniela Gonzales Aldape, Clay Cossé, Melanie Fry, and Mickey Stevens successfully defended Nissan North America, Inc. in a three-week jury trial in Houston, Texas.
Plaintiffs alleged a recalled wire harness in the engine compartment of the Nissan pickup truck suddenly caught fire due to manufacturing and design defects, killing a husband and father of two as he drove to work. After less than six hours of deliberation, the jury returned a defense verdict for Nissan. Plaintiffs’ closing argument sought over three-quarters of a billion dollars in compensatory damages alone.
To win, Dykema’s attorneys focused the jurors’ attention on eyewitness testimony and cellphone videos showing the fire started in the bed of the pickup, not the engine compartment where the recalled wire harness was located. The win represents this Dykema team’s fourth consecutive product liability defense verdict.
