$750K judgment against Five Star Electric Motors affirmed

HOUSTON - The First Court of Appeals recently affirmed a judgment of nearly $750,000 against Five Star Electric Motors in a breach of contract lawsuit. 

Court records show Thomas Patlovany sued his former employer, Five Star, alleging that the company refused to pay him the compensation he is owed for sales made before he resigned.

Following a bench trial, the trial court rendered a judgment awarding Patlovany $749,906.02 in damages. 

The First Court affirmed the judgment on March 14, court records show. 

Five Star appealed on several grounds, one of which argued that the trial court improperly construed the employment agreement between the parties, according to the company’s appellate brief.

“Because the signed employment agreement is dispositive, we need not address the other issues raised by the parties on appeal, including whether Patlovany could also recover the damages the trial court awarded to him on a theory of quantum meruit,” the opinion states.

“We affirm the trial court’s judgment.”
