Ferguson Law partners Chip Ferguson and Cody Dishon secure record-breaking $7.75 million settlement for mild traumatic brain injury

BEAUMONT - Two partners from The Ferguson Law Firm recently recovered a record-breaking settlement in a mild traumatic brain injury case.

Managing Partner Chip Ferguson and Equity Partner Cody A. Dishon secured a settlement of $7,750,000 for a 58-year-old Beaumont woman who suffered a mild traumatic brain injury (mTBI) in 2020, a press release states.  

According to both local and national news outlets, this is one of the highest recoveries ever obtained for a mTBI victim.  

“This recovery protects our client’s future and assures she will have access to the best medical care available,” Ferguson said. “Our only job is to provide for our clients and, here, we did so in record fashion. Nationally, it is one of the best recoveries in this type of case. That is a testament to a lot of hard work by a lot of people at our law firm.”  

Dishon added that the injury presented a challenge for the firm because, unlike a severe or moderate brain injury, a mild traumatic brain injury generally does not appear on traditional neuroimaging studies such as a standard MRI or CT scan.  

“And that was the case here, something the defense lawyers relied upon in defending the case,” Dishon said. “We arranged for our client to undergo more advanced neuroimaging testing that demonstrated our client’s mild traumatic brain injury. We then had other testing and retained the best experts in the field to help explain our client’s brain injury. The biggest misunderstanding about a mild traumatic brain injury is the impact on the victim. It is anything but mild.  

“Here, the impact on our client profoundly changed her life causing disruption professionally, economically, socially, and emotionally.”

Ferguson and Dishon previously resolved a mTBI case for $1.75 million and another brain injury case for $3.8 million. Ferguson also recently settled another mTBI for $3 million.
