Railroad worker sues Union Pacific after falling off bridge

TYLER - A railroad worker has filed a lawsuit claiming his supervisor rushed a job which caused him to fall off a bridge.

David B. Frederick filed suit against Union Pacific Railroad Co. on Dec. 23 in the Eastern District of Texas, Tyler Division. 

Frederick was employed as a railroad worker for Union Pacific. According to the lawsuit, on June 24, Frederick and his coworker were working at a bridge site in Prescott, Ark., The plaintiff alleges they were told that they had to complete the job quickly.

The suit states Frederick drove out on the bridge, exited the vehicle and fell from the bridge.

Frederick alleges the bridge on which he was working had no guard rails, walkways or a safe means to exit from a vehicle and tie off, according to the suit.

The defendant is accused of negligence for allegedly:

• Failing to adequately supervise the work;

• Failing to have proper guard rails or other barriers on the bridge to limit the ability for plaintiff to fall;

• Failing to provide a safe place to work;

• Rushing the job;

• Failing to properly plan the job: and

• Failing to have a walkway on the bridge.

The plaintiff is seeking an award of damages for medical expenses, loss of wages, loss of earning capacity, physical pain and suffering, mental anguish, physical impairment, physical disfigurement, household services, interest, and court costs.

A jury trial is requested.
